Cineplex is challenging a substantial $38.9 million penalty issued by the Competition Tribunal for allegedly misleading marketing practices. The company has submitted an appeal to the Federal Court of Appeal, hoping to overturn the decision.

In collaboration with the Competition Bureau, Cineplex has also requested a suspension of the fine until the appeal process is complete. The Appeal Court has granted an interim suspension while it reviews Cineplex’s motion.

The fine stems from a September tribunal decision, which supported the Competition Bureau's claim that Cineplex’s online booking process did not initially display the full ticket price. This practice, called drip pricing, became a point of contention after Cineplex introduced a $1.50 online booking fee in June 2022 for customers not enrolled in its CineClub subscription or Scene Plus loyalty program, both of which reduce or waive the fee.

Cineplex disputes these allegations, asserting that customers are promptly informed of any additional fees and can avoid them entirely by purchasing tickets directly at the theater.
